§1 PARTIES TO THE TRANSACTION

  1. The party making purchases in the store www.coffix.eu (hereinafter referred to as the "store") is an adult natural person , who is at least 18 years old or a company (hereinafter referred to as the "buyer").
  2. The party selling the products contained on the pages of www.coffix.eu is the owner - DMC TRADE SPÓŁKA CYWILNA, 80-180 Gdańsk, Siostry Faustyny 4c/10 NIP: 604-021-97-36.

§2 SECURITY

  1. All transactions concluded electronically are protected in accordance with the Act of August 29, 1997 on the Protection of Personal Data (Journal of Laws No. 133 item 883).

§3 COOKIE POLICY

  1. The website does not automatically collect any information, except for the information contained in cookies.
  2. Cookies (so-called "cookies") are IT data, in particular text files, which are stored in the Service User's terminal equipment and are intended for use on the Service's websites. Cookies usually contain the name of the website from which they originate, the time they are stored on the terminal equipment and a unique number.
  3. The entity placing cookies on the Website User's terminal equipment and gaining access to them is the operator of the Website, DMC TRADE Spółka Cywilna, with registered office at the following address: 80-180 Gdańsk, ul. Siostry Faustyny 4c/10
  4. Cookies are used for:
    • adjustment of the content of the Website's pages to the User's preferences and optimization of the use of websites; in particular, these files allow for recognition of the Website User's device and appropriate display of the website, adjusted to his/her individual needs;
    • maintaining a session of the Service User (after logging in), thanks to which the User does not have to re-enter his/her login and password on each sub-page of the Service.
  5. The Service uses two main types of cookies: "session" (session cookies) and "fixed" (persistent cookies). "Session" cookies are temporary files that are stored on the User's terminal device until the User logs out, leaves the website or shuts down the software (web browser). "Permanent" cookies are stored on the User's end device for the time specified in the parameters of the cookies or until they are deleted by the User.
  6. The following types of cookies are used within the Service:
    • "necessary" cookies to enable the use of services available on the Website, such as authentication cookies used for services that require authentication on the Website;
    • "functional" cookies, which allow "remembering" the User's selected settings and personalizing the User's interface, e.g. with regard to the chosen language or region of origin of the User, font size, appearance of the website, etc.

§4 STORE OFFER

  1. All prices of goods in the Store are given in Polish zloty and include VAT (gross prices).
  2. Products contained on the pages of the store are brand new, have the required approvals and permits allowing them to be marketed in Poland.
  3. Commercial information posted on the site does not constitute a commercial offer within the meaning of the Civil Code , but is an invitation to submit offers.
  4. The store reserves the right to change prices of goods on offer, to introduce new goods to the store's offer, to carry out and cancel promotional actions on the store's pages or to introduce changes in them.
  5. Photos of individual products presented in the store's offer may differ from the actual appearance of these products. Photographs, proportions and colors of products are the result of electronic image processing. Differences resulting from individual settings of the Purchaser's computer, such as different colors or proportions , cannot be the basis for a complaint about the ordered goods.

§5 ORDERS

  1. The order can be made by any adult person or company. Placing orders at www.coffix.eu is done through:
    • placing an order through the store's sales system ("add to cart")
    • sending an e-mail containing the details of the ordered goods and the necessary data of the Purchaser to info@coffix.eu
  2. Immediately after the order is placed, the store will send the Purchaser an e-mail with a message confirming receipt of the order.
  3. Confirmation will be sent to the address indicated in the form or e-mail from the Purchaser. The Confirmation will include: the name of the goods and other identifying details of the goods, the price for the goods, the total price for the ordered goods along with the cost of the declared form of transport or payment.
  4. Orders made through the store's sales system ("add to cart") are accepted for processing after confirmation by e-mail from the purchaser. In the absence of such confirmation, an employee of our store will contact the purchaser within 2 days of the order to confirm the order.
  5. The price of the goods is binding at the time the order is placed
  6. The order will be processed provided that the goods are available in stock or from the store's suppliers.
  7. If the goods covered by the order are not available at the store's warehouse or suppliers, the buyer shall be informed immediately, but no later than within the time limit specified for the fulfillment of the order for the goods in question, by sending an e-mail to the buyer. If, within 5 working days after the store sends the buyer a message about the status of the order, the buyer does not make any decision on further processing of the order, the order will be canceled in the part that cannot be processed by the store.
  8. In the case of goods covered by a promotion or sale, orders will be processed in the order of receipt of orders for these goods , until the stocks covered by this form of sale are exhausted.
  9. A VAT invoice is issued for each completed order. VAT invoice is issued at the time when the goods covered by the order are ready for shipment, delivery or at the time of receipt of the goods by the buyer.
  10. The buyer may withdraw the order in whole or in part until the goods are shipped.
  11. The dates of availability given next to the products are estimated dates. Each time an employee of the store will provide information confirming or changing the lead time.
  12. The availability period defines the time (expressed in business days) we need to bring the ordered product. Availability depends on the warehouse where the product is located or the availability of the product at our supplier. The lead time of the order is extended by the time needed for the selected form of transport. If the expected lead time is longer than the one stated on the site, a corresponding message will be sent. You can then decide to cancel the order or accept a longer lead time.
  13. In the case of some goods that are not very popular, the order will be processed after payment of min. 20% deposit. At the same time, we would like to inform you that products with properties specified by the consumer in the order placed by him or closely related to his person, the right of withdrawal from the contract concluded at a distance is not entitled to the consumer.

§6 DELIVERY AND COLLECTION OF ORDERS

  1. Goods covered by the order, are delivered to the customer via: transport service provided by our company, courier service (courier delivery).
  2. Delivery of goods is carried out in the manner specified by the purchaser in the form to the address given there, and it can only be an address in the territory of the Republic of Poland. Change of delivery address is possible only with prior approval of the store employee.
  3. The buyer is obliged to check the delivered goods/goods in the presence of the carrier for mechanical damage and compliance of the delivery with the order.

§7 PAYMENTS

  1. The purchaser in the Order indicates the form of payment.
  2. The buyer can choose the following forms of payment: cash on delivery (courier delivery), bank transfer or eDelivery (courier delivery),
    • Electronic payment - The most convenient and secure way to make a payment via the Internet. In our store we use the eCard payment system, to which you will be redirected to make a payment. The whole process is fast and secure - you choose your bank and make the payment.
    • The eCard system handles secure transactions:
      • debit card - Visa, Visa Electron, MasterCard, MasterCard Electronic, Maestro,
      • E-transfers - The list of currently supported banks is available after selecting this form of payment at the order stage,
      • other - I pay cash with Unikasa, Print and Pay.
  3. In the case of payment "transfer", the release of goods to the Purchaser takes place after the funds are credited to the Store's account.

§8 RETURNS AND COMPLAINTS

  1. Our store fully respects your rights under the Act of March 2, 2000 on the protection of certain consumer rights and liability for damage caused by dangerous products. (Journal of Laws No. 22, item 271). A consumer who has concluded an off-premises contract may withdraw from it without giving any reason, making a statement in writing within 10 days from the date of receipt of the goods, provided that the goods will be in an unchanged condition. The store does not accept cash on delivery and COD shipments. A copy of the sales document must be sent along with the returned product. If there are other non-returnable goods on the sales document, we will send you a corrective invoice after the order is changed. We guarantee a refund in the amount of the price of the product on the sales document within 10 days of receipt. We will send the amount by postal order or wire transfer to your account, in case of payment by credit card the refund will be made to the card.
  2. All goods available in the store are covered by the manufacturer's warranty.
  3. The basis for a complaint is the discovery of damage to the goods in the presence of the carrier. The condition for consideration of a complaint is to write a complaint protocol on the day of receipt of the shipment in the presence of an employee of the shipping company on the form of the transport company and send the protocol to the address of the store. Without a written complaint protocol with the carrier, complaints related to damage to the goods during transport will not be considered.
  4. Any complaints regarding hidden defects of goods will be dealt with in accordance with the procedures used by the manufacturers or their suppliers. If the complaint is considered legitimate, the defective goods will be repaired, exchanged for other - full-value , and if this is no longer possible (for example, because all the goods are sold out and out of stock or suppliers of the store), the store will return to the buyer the equivalent of the price of the goods or offer another, available in the store. The place to lodge a complaint is DMC TRADE Spółka Cywilna, 80-180 Gdańsk, 4c/10 Siostry Faustyny St. The complaint should be submitted in writing or by e-mail.

§9 PERSONAL DATA

  1. The administrator of personal data is DMC TRADE Civil Company, 80-180 Gdańsk, Sister Faustyna Street 4c/10, NIP: 604-021-97-36. Personal data are processed for the purpose and to the extent necessary for the execution of orders. Provision of data is voluntary, but necessary for the execution of orders. The data are not used for other purposes.

§10 FINAL PROVISIONS

  1. The buyer by placing an order , accepts the above rules of the store.
  2. Any disputes will be considered by the court having jurisdiction over the place of residence of the defendant or the place of performance of the contract.
  3. In matters not covered by these regulations , the relevant provisions of the Civil Code and other provisions of Polish law shall apply.
  4. All goods listed on www.coffix.eu may be registered trademarks of their manufacturers. The site uses them for commercial identification purposes only. All product information agrees with their manufacturers' catalog data.
  5. The buyer agrees that his e-mail address will be forwarded to DMC TRADE S.C., based in Gdansk, and that the Store and DMC TRADE S.C. will process his personal data in order to complete a survey with an opinion about a transaction made in the Store, in accordance with the provisions of the Personal Data Protection Act of 29.08.1997 ).
  6. Placing an order by the Customer is tantamount to consent to storing and processing by DMC TRADE Spółka Cywilna, 80-180 Gdańsk, ul. Siostry Faustyny 4c/10 personal data contained in the order, in accordance with the applicable provisions of the Act of August 29, 1997 on the Protection of Personal Data (Journal of Laws No. 133 item 883 as amended).
  7. The regulations enter into force on October 1, 2022.
